State Government
Now that you know the basics of State v. Federal, I will go into more detail about the State government. Each state is lead by a governor, which is elected by the people in the state. In addition to the governor, there are assemblymen/women who help advise the governor. Each state has its own set of laws. The people in each state are able to vote for the laws. It gets interesting when something is legal in the state, but not federally. An example of this is the marijuana law in both Colorado and Seattle. People are legally smoke pot according to the state, but if the federal government wants to arrest these people, they can. The line between what the state can do and what the federal government can do it interesting.
Federal Government
Federal Government is the government of the nation. Most of what has been talked about in this textbook pertains to the federal government. However, something I have not brought up is when a law is legal federally, but not state-wide. The greatest example of this is the idea of homosexual marriage. Federally, it is a law that homosexuals can get married because they are protected by both the first and fourteenth amendments. However, some states believe that this is not right. So, the states don't allow for these people to get married. Well, Federal law always trumps state laws. But it gets complicated. If the state does not want the people to get married, the people can't get married. Federal and state government gets very complicated.
